These Terms and Conditions (“Terms“) constitute a valid, binding, irrevocable, and legally enforceable agreement entered into between Little Cry Click (“Company“, “We“, “Us“, “Our“) and every individual, customer, client, parent, guardian, representative, or any other person (“You“, “Your“, “Client“) who accesses, browses, visits, or uses our website, communicates with us through telephone, WhatsApp, email, social media platforms, or any other mode of communication, confirms a booking, makes any payment, or otherwise avails any of our photography or related services.

By accessing our website, confirming a booking, making any advance or full payment, scheduling an appointment, visiting our studio premises, participating in any photography session, or availing any service whatsoever, You hereby expressly acknowledge, represent, warrant, and irrevocably agree that You have carefully read, thoroughly understood, and voluntarily accepted these Terms in their entirety, and that You shall remain legally bound by each and every provision contained herein. If You do not agree with any part of these Terms, You must immediately discontinue accessing our website and refrain from availing any of our services.

1. Nature of Services

Little Cry Click is a professionally managed photography brand primarily engaged in providing specialized photography and related creative services, including but not limited to Maternity Photography, Newborn Photography, Baby Photography, Baby Shower Photography, Baby Birthday Photography, Pre-Birthday Photography Sessions, and such other photography services as may be introduced by the Company from time to time.

The Company’s principal operational studio is situated in Dwarka, New Delhi, with additional operational branches located in Gorakhpur and Lucknow, together with affiliated partner studios functioning across the Delhi NCR region for the purpose of rendering professional photography services.

All services shall be rendered strictly in accordance with the selected package, prevailing studio policies, operational feasibility, and these Terms and Conditions.

2. Professional Experience & Infrastructure

Little Cry Click possesses more than five (5) years of professional experience within the photography industry and has successfully delivered photography services to 7,000+ satisfied clients across multiple locations.

The Company employs professional-grade cameras, lenses, lighting equipment, studio infrastructure, certified photographers, certified female makeup artists, premium maternity gowns, professionally maintained props, and an experienced post-production team to ensure the delivery of high-quality photographic services.

Notwithstanding the foregoing, the Company shall retain the exclusive right to determine the photographer, makeup artist, equipment, editing methodology, workflow, and other operational resources utilized for any particular session.

3. Booking Confirmation & Advance Payment

A photography session shall be deemed confirmed only upon the successful receipt of the prescribed advance payment by Little Cry Click.

The advance amount paid towards securing a booking shall remain strictly non-refundable, non-transferable, non-adjustable, and non-creditable, irrespective of the circumstances giving rise to cancellation, postponement, non-attendance, personal inconvenience, medical emergencies, change of schedule, dissatisfaction, or any other reason whatsoever.

Upon confirmation of a booking, cancellation by the Client shall not ordinarily be permitted.

However, rescheduling of a confirmed booking may, solely at the absolute discretion of Little Cry Click, be permitted subject to prior intimation by the Client, availability of photographers, studio schedules, operational feasibility, and such additional conditions as the Company may deem appropriate.

The Company’s decision with respect to any booking modification, postponement, or rescheduling shall be final, conclusive, and binding upon the Client.

4. Session Duration & Time Compliance

Every photography session shall be conducted strictly within the time duration allocated under the package selected by the Client.

For the avoidance of doubt, the duration specified in the selected package shall expressly include, without limitation, the time required for makeup, styling, costume selection, gown changes, concept preparation, photography, and all other related activities associated with the session.

In the event that the photography session exceeds the stipulated duration due to any act, omission, delay, request, or circumstance attributable to the Client, an additional charge of ₹1000/- per hour (or part thereof, wherever applicable) shall become immediately payable by the Client.

The Client is required to report at the scheduled time communicated by the Company.

Any delay or late arrival on the part of the Client shall neither entitle the Client to an extension of the originally allotted session duration nor constitute grounds for any refund, compensation, rebate, adjustment, or rescheduling, and the session shall conclude strictly at the originally scheduled time.

5. Client Obligations & Preparation Guidelines

The Client shall be solely responsible for ensuring full compliance with all instructions, guidelines, and preparatory requirements communicated by Little Cry Click prior to the scheduled photography session.

For the purpose of maintaining professional standards, hygiene, safety, and overall quality of the photography session, the following conditions shall be strictly observed:

• Wet hair is strictly prohibited during the photography session for reasons including, but not limited to, hygiene, styling consistency, and maintenance of the desired photographic outcome.
• Unless expressly included within the selected package, the Client shall independently arrange and bring all personal accessories, garments, footwear, jewellery, cosmetics, or any additional items required for the session.
• The Client shall carry all personal kits and essential belongings necessary for the photography session.
• In the case of maternity photography sessions, the Client shall bring the ultrasound report, pregnancy kit, or any other maternity-related accessories wherever required for the selected concept or pose.

Failure by the Client to comply with any of the above requirements may adversely affect the quality, duration, or execution of the photography session, for which Little Cry Click shall bear no responsibility or liability whatsoever.

6. Gowns, Props & Final Selection

The selection of gowns, outfits, accessories, props, backgrounds, themes, and other studio materials made by the Client prior to or during the photography session shall be deemed final, conclusive, and irrevocable.

Once such selections have been confirmed by the Client, no request for alteration, replacement, modification, exchange, or substitution shall be entertained under any circumstances whatsoever.

All gowns, props, costumes, and accessories shall remain subject to availability, maintenance schedules, and operational feasibility as determined exclusively by Little Cry Click.

7. Payment Clearance & Data Handover

The Client shall ensure that the entire outstanding balance payable under the selected package is cleared immediately upon completion of the photography session, unless otherwise expressly agreed by Little Cry Click in writing.

Until full and final payment has been successfully received and acknowledged by the Company, no RAW photographs, edited photographs, creative photographs, videos, albums, digital files, previews, downloadable content, or any other deliverables whatsoever shall be released, transferred, shared, or handed over to the Client.

Little Cry Click shall retain an absolute and unconditional right to withhold all deliverables until complete payment obligations have been duly discharged by the Client.

8. Editing, Revisions & Artistic Discretion

The Client shall be entitled to one (1) complimentary revision only after the delivery of the edited content.

For the purposes of these Terms:

Creative Photo

A Creative Photo refers to a photograph that undergoes advanced and comprehensive post-production editing, including but not limited to background enhancement and/or replacement, cinematic colour grading, premium skin retouching, lighting manipulation, visual effects, artistic compositing, creative enhancements, and other advanced editing techniques intended to produce a distinctive, premium, and highly creative final image.

Edited Photo

An Edited Photo refers to a photograph that undergoes standard professional post-processing, including basic retouching, colour correction, skin smoothing, exposure balancing, lighting adjustments, and general finishing, without the incorporation of extensive creative effects or advanced artistic manipulations.

The Client expressly acknowledges and agrees that only one (1) revision shall be provided after delivery of the edited content.

Any request for additional revisions, modifications, alterations, corrections, enhancements, or re-editing beyond the aforementioned complimentary revision shall be treated as a chargeable add-on service, the applicable charges for which shall be determined solely by Little Cry Click.

Furthermore, all creative and artistic decisions including, but not limited to, posing, expressions, framing, camera angles, lighting arrangements, composition, colour grading, background selection, editing style, visual effects, and overall artistic presentation shall remain within the sole, absolute, and exclusive professional discretion of Little Cry Click, and the Company’s decision in this regard shall be final, binding, and not open to dispute.

9. Data Retention & Responsibility

All photographs, videos, RAW files, edited files, project files, and all other digital data generated during the photography session shall be securely retained by Little Cry Click for a maximum period of fifteen (15) days from the date of the photography session.

Upon the expiry of the aforesaid retention period, Little Cry Click shall be entitled, at its sole discretion and without any prior notice, to permanently delete, archive, overwrite, or otherwise dispose of such data.

Accordingly, the Company shall bear no responsibility or liability whatsoever for any loss, deletion, corruption, damage, retrieval failure, or non-availability of the Client’s data after the expiration of the said retention period, and the Client expressly waives any claim arising therefrom.

10. Confidentiality & Data Privacy

All photographs, videos, digital files, personal information, and other materials generated or collected during the course of the photography session shall be treated as strictly confidential by Little Cry Click.

The Company shall not disclose, distribute, transfer, publish, or otherwise share the Client’s photographs or videos with any third party under any circumstances, except where such disclosure is required under applicable law, pursuant to a lawful governmental or judicial order, or with the prior written consent of the Client.

All deliverables shall be released exclusively to the respective Client or to a person expressly authorized by the Client.

Little Cry Click shall implement reasonable administrative and operational measures to safeguard the confidentiality and privacy of the Client’s photography data.

11. Portfolio & Promotional Rights

Little Cry Click reserves the exclusive, perpetual, worldwide, and irrevocable right to utilize, reproduce, display, publish, and showcase selected photographs, videos, reels, or other visual content created during the photography session solely for the purposes of portfolio presentation, publication on the official website, social media platforms, digital marketing, advertising campaigns, exhibitions, competitions, branding, promotional activities, and other legitimate business purposes.

Under no circumstances shall such content be sold, licensed, assigned, transferred, or otherwise commercially exploited by Little Cry Click in favour of any unrelated third party for independent commercial gain.

Furthermore, the Client shall be entitled to only one (1) revision strictly after the delivery of the edited content. Any subsequent revision, modification, alteration, correction, enhancement, or re-editing request shall be treated as a chargeable service, the applicable charges for which shall be determined solely by Little Cry Click.

The Client further expressly acknowledges and agrees that all photographs, videos, concepts, poses, backgrounds, props, themes, visual references, sample images, promotional materials, portfolio content, website galleries, and social media posts displayed by Little Cry Click are purely illustrative and demonstrative in nature, and are intended solely to exhibit the Company’s artistic style, quality standards, and creative capabilities.

Accordingly, the Client shall not expect, demand, or claim an identical or one hundred percent (100%) replication of any displayed sample, reference image, advertisement, or promotional material, as the final outcome of every photography session may reasonably vary depending upon, inter alia, lighting conditions, location, weather, client participation, body posture, makeup, costume selection, equipment limitations, artistic interpretation, editing methodology, and other practical or creative considerations.

12. Limitation of Liability

To the maximum extent permissible under the applicable laws of India, Little Cry Click, its proprietors, employees, photographers, editors, makeup artists, representatives, affiliates, and associated personnel shall not be held liable for any direct, indirect, incidental, consequential, exemplary, special, punitive, or compensatory loss or damage arising out of or in connection with the services provided.

Without prejudice to the generality of the foregoing, Little Cry Click shall not be liable for:

• Any subjective dissatisfaction, personal opinion, or aesthetic expectation regarding the quality, style, editing, composition, or artistic outcome of the photographs or videos;
• Any delay, interruption, postponement, or cancellation resulting from circumstances beyond the reasonable control of the Company, including but not limited to natural disasters, governmental restrictions, equipment malfunction, illness, accidents, traffic conditions, or any event constituting force majeure;
• Any loss, damage, inconvenience, or adverse consequence arising directly or indirectly from the Client’s failure to comply with the Company’s instructions, preparation guidelines, studio policies, or these Terms and Conditions.

The aggregate liability of Little Cry Click, if any, shall in no event exceed the total amount actually paid by the Client for the specific photography service giving rise to such claim.

13. Amendments & Modifications

Little Cry Click reserves the absolute, unrestricted, and unilateral right, at its sole and exclusive discretion, to modify, amend, revise, supplement, substitute, or otherwise update these Terms and Conditions, in whole or in part, at any time and without any prior notice or obligation to notify the Client individually.

Any such amendment, modification, or revision shall become effective immediately upon its publication on the official website or upon its implementation by the Company, as the case may be.

The Client’s continued access to the website, continued communication with the Company, confirmation of any booking, or continued use of any service after such modification shall constitute the Client’s irrevocable acceptance of the revised Terms and Conditions, and the Client shall thereafter remain legally bound by the same.

14. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by, construed, interpreted, and enforced exclusively in accordance with the applicable laws of the Republic of India, without regard to any conflict of law principles.

Any dispute, controversy, claim, difference, or legal proceeding arising out of, relating to, or in connection with these Terms and Conditions, the website, any booking, payment, photography session, or any service rendered by Little Cry Click shall be subject to the exclusive jurisdiction of the competent courts situated at New Delhi, and the Client hereby irrevocably submits to the exclusive territorial jurisdiction of such courts.

15. Acceptance of Terms

By accessing the website, submitting an enquiry, confirming a booking, remitting any advance or full payment, participating in any photography session, or otherwise availing any service offered by Little Cry Click, the Client hereby expressly acknowledges, represents, warrants, and irrevocably agrees that they have carefully read, fully understood, and voluntarily accepted these Terms and Conditions in their entirety, and that they shall remain legally bound by each and every provision contained herein without exception.

Furthermore, in the event that the Client requests any customized, exclusive, premium, celebrity-inspired, designer, luxury, or trending photography concept that is not expressly included within the selected package and which necessitates the arrangement, procurement, rental, purchase, or engagement of any additional gowns, costumes, props, accessories, décor, floral arrangements, premium setups, rented venues, luxury vehicles, animals, third-party vendors, permissions, licences, or any other supplementary resources, the entire cost thereof, including but not limited to procurement charges, rental charges, vendor fees, transportation expenses, permission charges, licence fees, taxes, and all other incidental or ancillary expenditures, shall be borne solely and exclusively by the Client.

Wherever deemed necessary by Little Cry Click, the Client may additionally be required to execute a separate quotation, written approval, undertaking, consent, or agreement prior to the execution of such customized or trending concept. Little Cry Click shall be under no obligation whatsoever to arrange, execute, or facilitate any such concept unless all applicable charges have been fully paid in advance and the required approvals or agreements have been duly executed by the Client.

By proceeding with the booking, the Client further confirms that no oral statement, representation, assurance, promise, advertisement, sample photograph, promotional material, social media content, or communication of any nature shall override, modify, or supersede these Terms and Conditions unless expressly agreed to by Little Cry Click in writing.
